1. Purpose and Scope

This Acceptable Use Policy ("AUP") governs your use of all services provided through Metatrader-VPS.com by Apex Vanguard Dynamics LLC (the "Company", "we", "us"). It is incorporated into and forms part of our Terms and Conditions. Capitalized terms have the meaning given in the Terms.

This AUP exists to protect the Company, our customers, the wider internet, and the third-party infrastructure providers and data centers ("Infrastructure Providers") whose capacity underpins the Service. Because the Service is delivered on top of Infrastructure Providers, you must comply not only with this AUP but also with the acceptable-use and operational policies of those Infrastructure Providers, as applied to you through the Company. We may update this AUP at any time to remain consistent with those upstream requirements and with applicable law.

By using the Service, you agree to this AUP and are responsible for ensuring that anyone you allow to use your VPS also complies with it.

2. General Principle

You may use the Service only for lawful purposes. You must not use the Service, or allow it to be used, in any way that: is illegal under the laws applicable to you or to the location where the underlying infrastructure operates; infringes the rights of others; compromises the security, stability, or reputation of the Service or any Infrastructure Provider; or breaches the policies of any Infrastructure Provider, network, or upstream supplier.

3. Prohibited Activities

You must not use the Service to host, run, store, transmit, facilitate, or engage in any of the following:

3.1 Illegal content and conduct

Any content or activity that is illegal under applicable law, including fraud, money laundering, terrorist financing, or the sale of illegal goods or services.
Any material that sexually exploits or endangers minors (CSAM). We report such material to the authorities and terminate immediately and without notice.
Content that infringes intellectual property rights, including pirated software, media, or unlicensed distribution.

3.2 Security abuse and malicious activity

Malware, ransomware, viruses, worms, trojans, rootkits, botnets, command-and-control servers, or any tooling designed to harm, compromise, or gain unauthorized access to systems or data.
Unauthorized scanning, penetration testing, denial-of-service (DoS/DDoS) activity, brute-forcing, credential stuffing, or any attempt to breach or probe systems you do not own or have explicit written authorization to test.
Phishing, spoofing, pharming, carding, or any activity intended to deceive or defraud users into disclosing credentials or financial information.

3.3 Network and messaging abuse

Sending unsolicited bulk or commercial email (spam), SMS spam, or operating open mail relays or proxies for abuse.
Falsifying headers, IP addresses, or identifiers, or evading spam filters or IP blocklists.
Any activity likely to cause the Service's IP ranges to be blocklisted.

3.4 Resource and infrastructure abuse

Activity that places a disproportionate or abusive load on shared resources, or that degrades service for other customers or for Infrastructure Providers.
Cryptocurrency mining, distributed computing for profit, or similarly resource-intensive workloads where prohibited by the applicable plan or by an Infrastructure Provider (contact us if you are unsure whether your workload is permitted).
Circumventing resource limits, billing, or usage restrictions, or reselling the Service in breach of the Terms.

3.5 Prohibited and high-risk content categories

Content or services relating to weapons, explosives, or controlled substances where unlawful.
Operating unlicensed financial, money-services, gambling, or lottery operations where a license is legally required.
Content that is defamatory, harassing, threatening, or that incites violence or unlawful discrimination.

3.6 Sanctions and export control

Use of the Service by, or for the benefit of, any person, entity, or country subject to applicable sanctions or embargoes (including those administered by the U.S. Office of Foreign Assets Control (OFAC)), or in violation of export-control laws.

4. Trading-Specific Conduct

Because the Service is commonly used to run MetaTrader and other Trading Software, you additionally agree that:

4.1 You will operate trading software, expert advisors, scripts, and automated strategies only in compliance with the rules of your broker(s), the trading platform provider(s), and applicable financial-market laws and regulations in your jurisdiction.

4.2 You will not use the Service to engage in market manipulation, unauthorized market data redistribution, unlicensed money management or fund handling for third parties, or any activity that requires a financial license you do not hold.

4.3 You acknowledge that the Company provides infrastructure only and does not monitor, endorse, or take responsibility for your trading conduct, and that responsibility for regulatory compliance of your trading activity rests entirely with you.

5. Your Security Responsibilities

5.1 You are responsible for securing your VPS, including applying updates and patches, configuring firewalls, using strong credentials, and securing any software you install.

5.2 A VPS compromised due to your failure to secure it, and used to carry out prohibited activity, is treated as your violation of this AUP.

5.3 You must promptly cooperate with any reasonable request by the Company to investigate or remediate a suspected violation or security incident.

6. Enforcement

6.1 Investigation and action. If we become aware of a suspected violation — whether through our own monitoring, a customer or third-party complaint, or a notice from an Infrastructure Provider — we may investigate and take any action we consider appropriate, including issuing a warning, filtering traffic, throttling, removing content, suspending the VPS, or terminating the account.

6.2 Immediate action without notice. For severe violations — including CSAM, active malicious attacks, activity causing imminent harm, or where an Infrastructure Provider requires immediate action — we may suspend or terminate the Service immediately and without prior notice.

6.3 Upstream-driven enforcement. You acknowledge that Infrastructure Providers may independently suspend, restrict, or remove workloads. Where an Infrastructure Provider takes such action or directs us to do so, we may act accordingly, and we are not liable to you for doing so. This is a core consequence of the reseller model described in the Terms.

6.4 No refunds for violations. Suspension or termination for a violation of this AUP does not entitle you to any refund, and you remain liable for any resulting charges, fees, or costs, including fines or clean-up costs passed through by an Infrastructure Provider.

6.5 Cooperation with authorities. We may report unlawful activity to, and cooperate with, law enforcement and relevant authorities, and disclose information as required by law or by an Infrastructure Provider's lawful process.

7. Reporting Abuse

To report suspected abuse, security incidents, or violations of this AUP, contact [email protected] with as much detail as possible (including relevant IP addresses, timestamps in UTC, and log excerpts). We review reports promptly.

8. Changes to this AUP

We may update this AUP at any time, including to align with changes required by Infrastructure Providers or by law. The current version is always available on our website, and material changes take effect on posting or on the stated effective date.
