1. Overview

This Refund and Service Level Policy ("Policy") describes our service reliability practices and the circumstances in which refunds are and are not available. It is incorporated into and forms part of our Terms and Conditions. Capitalized terms have the meaning given in the Terms. In case of conflict between this Policy and the Terms, the Terms govern except where this Policy provides more specific detail on refunds and service levels.

2. Service Reliability

2.1 We work to provide consistently reliable, high-uptime VPS hosting, and we monitor the real, live status of every region we operate in.

2.2 We do not own the underlying physical infrastructure. The Service is delivered on top of capacity supplied by third-party Infrastructure Providers that we do not own, operate, or control. We do not control, and do not guarantee, the uptime, hardware, network, or operational decisions of those providers, and this Policy does not offer a fixed contractual uptime percentage.

2.3 For transparency, we publish real, continuously monitored uptime data — by city and country, without naming any underlying Infrastructure Provider — at metatrader-vps.com/uptime. This reflects actual, live monitoring results, not a promise, forecast, or contractual commitment, and it is provided for informational purposes only.

2.4 If a Downtime incident is confirmed as caused by a fault within our own direct control (as opposed to an Infrastructure Provider, the public internet, your broker, or any other cause outside Section 3), we may, at our sole discretion, issue a non-cash service credit toward a future invoice for the affected VPS. Any such credit is discretionary, is not owed as a matter of contractual entitlement, is not available for issues covered by Section 3, and is not redeemable for cash. Service credits, where issued, are the only form of compensation available for availability issues — see Section 4.

3. What We Are Never Responsible For

The following are outside our direct control and are never grounds for a service credit or a refund:

4. No Compensation for Trading Losses

We do not compensate for trading losses, missed trades, execution failures, or any consequential loss arising from Downtime, latency, or connectivity, under any circumstances. Any service credit under Section 2.4 is strictly limited to a percentage of hosting fees and never extends to trading-related loss of any kind, consistent with the disclaimers and limitation of liability in the Terms.

5. Refunds

5.1 All fees are non-refundable. Because VPS services are provisioned on demand and consume real infrastructure capacity immediately upon activation, all fees are non-refundable once the Service has been provisioned, including but not limited to:

We do not offer trial periods, money-back guarantees, or discretionary goodwill refunds of any kind. This is a deliberate policy, not an oversight — please make sure a plan is right for you before purchasing.

5.2 Renewals. Subscriptions renew automatically (see the Terms). It is your responsibility to cancel before the renewal date. Renewal charges are non-refundable under all circumstances, including where the VPS was not used after renewal.

5.3 How the one legal exception works. Section 6 describes a narrow right of withdrawal that mandatory consumer law grants to some customers, which we cannot contract around. Outside that specific, legally-mandated exception, Section 5.1 applies without exception.

6. Consumer Withdrawal Rights (EU/EEA and Similar)

6.1 If you are a consumer in the EU/EEA (or another jurisdiction with equivalent rules), you may have a statutory right of withdrawal — typically 14 days — for distance contracts. This is a right granted by law, not by this Policy, and we cannot remove it by contract.

6.2 Immediate performance and waiver. For the supply of digital services (such as immediate provisioning of a VPS) that begin during the withdrawal period, applicable law generally allows the right of withdrawal to end once performance has begun, provided you have given your express prior consent to immediate performance and acknowledged that you lose the right of withdrawal once the service is fully performed (and, for partially performed services, that you will pay for the part already provided). By requesting immediate provisioning of your VPS, you expressly consent to the Service beginning immediately and acknowledge that you thereby lose your 14-day right of withdrawal to the extent the Service has been performed, to the extent permitted by applicable law.

6.3 Where mandatory consumer law grants you a non-waivable refund or withdrawal right that this Policy cannot lawfully exclude, that right prevails over Section 5 to the extent of the conflict, and only to that extent.

7. Chargebacks and Disputes

7.1 If you believe you have been charged in error, contact us first at [email protected]. We aim to resolve billing issues promptly and fairly, within the bounds of Section 5.

7.2 Initiating a chargeback or payment dispute without first contacting us is a breach of the Terms. We reserve the right to suspend or terminate the account, dispute the chargeback with evidence, and recover associated fees and costs. Accounts with unresolved chargebacks may be blocked from future purchases.

8. Changes to this Policy

We may update this Policy from time to time. The current version is always available on our website, and material changes take effect on posting or on the stated effective date. Changes apply to fees charged after the effective date.
